The paper, on which the will was written, has turned yellow. The property of Moses Booth was divided amoung his three (3) children and wife, each one being given several slaves, whose names were given.' The writing was very small and, although very neat, it was hard to read. The above from the papers of the Libray of Virginia and the personal effects of Mary Pulley. The owners of the will in order have been: 1799.....Peter Booth 1875.....Sam Booth (Col. Samuel Booth) 1917.....Annie L. Holmes 1936....Mary Pulley Current location unknown but now being traced. Moses is listed as first born son because in his father's will dated 1757 he received the remainder of his father's estate after his brothers received a specific share and the plantation of his fathers and is listed as the sole executor of his father Robert Booth III's will. Moses' father Robert gave him the plantation where he lived, there being approximately 370 acres. He also gave Moses six slaves; Harry, Peter, Betty, Tony, Ephraim, and Ben. He gave Moses the remainder of the estate after all debts and legacies were paid.

_______________ WILL--Southampton County Wills and Probates, Courtland Circuit Court, VI BOOTH, Moses- In the name of God, Amen, I MOSES BOOTH of the parish of Nottoway County of Southampton do make and ordain this to be my last will and testament First--it is my desire than my just debts and funeral expenses should be paid by the sale of the brandy which may be madeon my plantations this present year. Second--I lend to my loving wife Diana Booth the use of the plantation on which I now live and also 1/3 part of all the personal property of which I die possessed. To her also the use of the following negros viz Peter, Isaac, Hannah, Molly, Ephraim,and Gilbert during her widowhood. Thirdly--I bequeath to my son Peter Booth the land I purchased of Benjamin Philips the North side of the Lightwood Swamp containing by estimation two hundred acres also a tract of land on the aforesaid swamp which I purchased of Phillips Booth. Fourthly---I bequest to my aforementioned son Peter the following negros old Harry, 1 negro Genny, Marry, Daniel, Beck, Avey, Lucy, Betty and Dilly and also one third part of my personal estate to him and his heirs. Fifthly--I bequeath to my son John Booth three hundred and twenty two acres of land which I purchased of Moses Booth (Jr) also the plantation on which I now live after the marriage or decease of my wife. I also bequeath to my said son John Booth the following negros Roger, Ben, Leah, Alice, Lydia, Jesse and Carolina and young Jenny. Also one third part of my personal estate to him and his heirs. Lastly--I bequeath to my daughter Martha Warren the following negros, Pleasant and her children (children listed illegible) to Martha and to her heirs. Seventhly--It is my desire that my loving wife Diana Booth should dispose ot the one third part of my personal estate bequeathed to her as she pleases after her death or second marriage. It is my will that my negros Ephraim, Isaac and Molly should be the property of my son Peter and his heirs and that my negros Peter, Hannay and Gilbert should be the property of my son John and his heirs. Lastly I bequeath the residue to my son Peter to him and his heirs and thereby appoint my two sons Peter and John executors of this my last will and testament revoking all wills by me heretofore made. Moses Booth Sr.'s will further proves that Diana Morris is his second marriage by stating that upon her death or second marriage the land goes to son John. The land that he bequeathed to son John was purchased from Moses Booth Jr.and his wife SARAH (not the previously stated DIANA as some records mistakenly show as Moses Jr.'s wife) and given to LEWIS N. BRANCH from John Booth 'in his own right and as guardian to Ann and Patsey Booth April 1832' not LEWIS BOOTH as a Boothe microfilm and researcher states. The land record on the margin is hard to read but the name is clearly not LEWIS BOOTH. A copy of the land record is in the possession of Terri Jensen.

This is the correct one that married Diana Morris Surety for marrage posted by Robert Russell Wit to marriage: Samuel Kello.

Will was last in the possession of Mary Pulley in Ivor, Va., in 1936.

[p.399] At a Court held for Surry County, June the 24th 1806. Present. Robert Mc.Intosh, Nicholas Sebrell, John H. Cocke & Archibald Davis Gentlemen Justices.
Upon the petition of Stephen Lucas for leave to open a new Road, the persons appointed to view the way proposed returned their report in these words to wit, "Agreeably to an order of the worshipful Court of Surry County hereto annexed We Edward Marks, Robert Booth, Thomas Bishop and Herman Bishop hath viewed the way proposed to open a Road from the Otterdam meeting house in the Huntington road opposite to Stephen Lucas's plantation, and we find that no inconvenience can result in consequence of opening the said Road, and believe that the publick will be much benefitted by the same" (signed) "Edward Marks, Robert Booth, Thomas Bishop, Herman Bishop" The same being read and considered it is ordered that leave be granted to open the said Road from the Otterdam meeting house to the Huntington Road, that the same compose a District to be denominated the Otterdam Meeting house Road, that Robert Booth be surveyor thereof and that he, with the male labouring tithables of himself, Stephen Lucas, Nicholas Hite, Thomas Bishop, Robert Davis, James Bishop, Jonathan Richards, and [p.401] Abraham Freeland do keep the said Road in constant good repair.
