On the court case with Aaron's murder in Sussex County, VA is this.... AARON BOOTH'S MURDER This is from the 1754-1801 Sussex County Virginia Court Records at page 48:
"At a Court held at Sussex Courthouse on the 31 day of August 1791 for the examination of William HARGRAVE on Suspicion of his being guilty of murdering Aaron BOOTH Present David MASON, Robert JONES, David MASON Jun. and John MASSENBURG Gent. The above named William HARGRAVE being Committed to the Jail of this County charged with the murder aforesaid was led to the bar in Custody of the Sheriff and thereupon divers Witnesses were sworn and examined to Wit: Mich. HARRED, Lewis BOOTH, Richard BOOTH, Joshua BAILEY, Lucy HUTCHINGS, Brittain BRITTLE, Jordan and Mark JUDKINS, Harris HUTCHINGS, Elizabeth HARWOOD, William FREEMAN and Nathl. FELTS council being heard on behalf of the Prisoner and on the question for his being sent on for further trial, The Court were divided in Opinion therefore the Prisoner is Acquitted. Colo.David MASON Senr. and Robert JONES Gent. being of Opinion that the Prisoner ought to be sent for further trial, which they direct may (sic) entered of Record. The minutes of these Proceedings were Signed by David MASON, Robt. JONES, David MASON Jur. Jno. MASSENBURG.' This court record shows a possible 'brother' of Lewis being Richard. The Brittle, Hutchings, Baileys, etc., were all intermarried families with the Windhams and Booths. I have most of the documentation on just who married 'who' but it is very 'round-about'. Wyche decd vs.. in debt AARON BOOTH and Joseph El beds and furniture, 2 sows and their pigs and 10 sheets (?), 2 dishes, six pewter plates one basin, 2 iron potts, 23 barrels of corn now on the plantation now live, one chest, one table, one frying pan the above all being on the land and plantation whereon I now live lying and being in the aforesaid County of Southampton with all the appert. belonging or in anywise appertaining to the premises hereby granted or intended to be granted and the reversion and reversions remainders and remainders and all forever benefit the peoples of the said flocke, horse, hogs, and furniture aforesaid and the remaining and all my rights claims, interest and securities relating to the farm to have and to hold these articles above mentions and other premises unto the said Briggs and Blow their heirs and assigns forever and the said AARON BOOTH do hereby grant for himself and for his heirs that he the said AARON BOOTH and his heirs and every of them shall and will warrant and forever defend the said sundry things above and other premises and every part and article thereof with all and singular their rights and appe (??)unto the said Briggs and Blow their heirs and assigns forever against him the said AARON BOOTH and against heirs and every of them against every other person whosoever upon trust never the less that the said Briggs and Blow their heirs Executors administrators or assigns shall thinks proper of the said AARON BOOTH shall request them whichever of these two circumstances shall first happen sell for the best price that can be gotten after giving ten day public notice that the said stock, household and furniture and premises and out of the money arising from such sale discharge pay and satisfactory them the said Briggs and Blow the above mentioned sum of twelve pounds with lawful interest from the 8 day of December 1773 until the same shall be fully discharged and the expenses attending the drawing and recording this indenture and the contingent charges of the sale as aforesaid and other necessary expenses that attend the securing and attaining the above mentioned money as performing any thing that is or shall be necessary in relation to the intent of this indenture and that the said Briggs & Blow their heirs executors administrators or assigns shall pay of cause to be paid the overflow is any remain from such sale to the said AARON BOOTH his heirs executors administrators or to his order. Aaron was quite a troubled individual and had many 'trials' with the Southampton
Court, like an arrest for playing cards on Sunday and then snubbing his nose
at the authorities for the fines and the arrest!!

The attachment awarded against the defendant's estate being returned
executed on ten cars (??) of corn, Whereupon this day came as well the
plaintiff by his attorney as the defendant in his proper person who
confessed the plaintiff's action for ten pounds the debt in the declaration
mention therefore it is considered by the court that the plaintiff recover
against the said defendant the said ten pounds and his cost by him about his
suit in this behalf expended and the said defendant in (??). But this
judgment (except as to the cost) is to be discharged by the payment of three
pounds two shillings and two pence three farthings together in interest from
the January 1773 till paid.

Moses Booth Sr.'s will further proves that Diana Morris is his second marriage by stating that upon her death or second marriage the land goes to son John. The land that he bequeathed to son John was purchased from Moses Booth Jr.and his wife SARAH (not the previously stated DIANA as some records mistakenly show as Moses Jr.'s wife) and given to LEWIS N. BRANCH from John Booth 'in his own right and as guardian to Ann and Patsey Booth April 1832' not LEWIS BOOTH as a Boothe microfilm and researcher states. The land record on the margin is hard to read but the name is clearly not LEWIS BOOTH. A copy of the land record is in the possession of Terri Jensen.

Robert Booth married Sarah (--?--) probably between 1689 and 170. Her birth name may have been "Shelly". Sarah was identified in the record of a law suit in Surry County, Virginia, as "Sarah, wife of Robert Booth" which indicates that she was appearing in the suit and thus must have had an interest in her own right in the outcome of the lawsuit. The suit had been filed against Sarah, the wife and the Executrix of Philip Shelly, deceased. Sarah Wakefield Shelly, the executrix, became the wife of Christopher Smith during the administration of the will of the estate of her deceased husband Philip. This court record and her son named "Shelly" are indications that Sarah's birth name might have been "Shelly". In addition, Sarah Booth's grandson Philip Booth (the son of Shelly Booth) may have been a namesake of Philip Shelly of Surry County, Virginia.

Robert Booth executed his will on 1757.10.6 in Nottoway Parish, Southampton County, Colony of Virginia. The text of the will:

Robert Booth probably died in 1759 in Nottoway Parish, Southampton County, Colony of Virginia. Although Robert Booth's will was dated 6 October 1757, it was not presented to the court for probate until the 10th of January in 1760. It appears likely therefore that he died sometime in late 1759.<5>
Robert Booth's will was probated on 1760.1.10 in Southampton County, Colony of Virginia. The Southampton Court stated: "At a Court held for the County of Southampton the 10th day of January 1760 This Will was presented on Court by Moses Booth the Exor therein named proved by the oaths of Joseph Gray & Barnaby Bailey two of the witnesses thereto & ordered to be Recorded and on the motion of the said Exor who made oath according to Law Certificate was Granted him for obtaining a probat [sic] hereof in due (last line illegible) Test R Kello."<6>
Robert Booth's estate was the subject of an inventory dated 1760.2.7 and filed by executor Moses Booth the 13th of March in Southampton County, Colony of Virginia. Robert Booth executed his will on 1757.10.6 in Nottoway Parish, Southampton County, Colony of Virginia. The text of the will:
"In the name of God Amen I Robert Booth of the parish of Nottoway & County of Southampton do make this my Last Will & Testament in manner Following towit - Imprimis I give unto my son Arthur Booth & his heirs forever the upper part of the Land I bought of Robert Barham whereon my son now Lives according to the following Bounds Beginning at a gum on the south side Lightwood swamp thence along a Line of mark'd Trees near the Road made by myself to a Red Oak or Corner Tree of my said Sons Land that he Bought of Allen Warren Containing about Two hundred acres be it more or Less Item I Give Unto my son Robert Booth & his heirs forever all that part of my Land that Lyes Below the Line made [by?] my son Arthur & the mouth of the More Branch thence up the Branch to the head thereof thence along a line of mark'd trees made by myself to a Red Oak a Corner Tree of his Brother Arthurs Land that he Bought

Robert Booth probably died in 1759 in Nottoway Parish, Southampton County,Colony of Virginia. Although Robert Booth's will was dated 6 October 1757, it was not presented to the court for probate until the 10th of January in 1760. It appears likely therefore that he died sometime in late 1759.<5>
Robert Booth's will was probated on 1760.1.10 in Southampton County, Colony of Virginia. The Southampton Court stated "At a Court held for the County of Southampton the 10th day of January 1760 This Will was presented on Court by Moses Booth the Exor therein named proved by the oaths of Joseph Gray & Barnaby Bailey two of the witnesses thereto & ordered to be Recorded and on the motion of the said Exor who made oath according to Law Certificate was Granted him for obtaining a probat [sic] hereof in due (last line illegible) Test R Kello."<6>
Robert Booth's estate was the subject of an inventory dated 1760.2.7 and filed by executor Moses Booth the 13th of March in Southampton County, Colony of Virginia. The record of the inventory stated "A true Inventory of the Estate of Robert Booth deced given with under my hand 27th
