His will, dated 3/27/1770 and probated 7/17/1770, mentions only his son
William and granddaughter Elizabeth Barham. The granddaughter, Elizabeth,
was probably a daughter of Thomas Barham,d. 1764, and his wife Lucy Holt,
daughter of Benjamin Holt of Surry Co. whose will in 1770 mentions his
daughters Lucy Barham and Ann Bell, and sons Joseph, Michael, and Phillip
Holt.

In 1661 he is mentioned in the records as a vestryman in Lawnes Creek Church,
which was the first church built(in 1628)on the south side of the James River.
In 1681, he moved his family to James City Co.,and at his death in 1683
owned 463 ac. known as "Martin's Hundred" which he left to his oldest son,
Charles Jr. who remained in James City Co.

"Captain Charles Barham of Surry descends from the ancient family of Barham in Kent,
whose pedigree begins with Warine de Barham, who in1210 held lands in Berham, near
Canterbury, by Knight service as one of the military tenants of the Archbishop of
Canterbury. (See article by R. G. Fitzgerald-Uniache, B. A. F. R. S. A. Sussex Arch.
Soc. LVI (1914) p.110). This family has also resided in Surry County, Virginia
continuously for more than 300 years. It's present representative is Mr. S. B. Barham,
now Clerk of the County Court.

Captain Barham first appears in the Surry records in 1654 as a witness to a bond of
Andrew Robinson to Dorothy Kew. (D. W. 1645-1715, p.43). He was a vestryman of Lawne's
Creek Parish first appearing on the list May 24, 1661. On February 2, 1663, Charles
Barham, gent., of Lawne's Creek Parish bought 300 acres on Hog Island, formerly owned
by John Medmore, willed to him by heirs in England. Captain Barham paid 63 guineas
sterling with bills of exchange drawn on his brother RICHARD BARHAM of London. Wits.:
Wm. Cockerham, Andrew Robinson, David Williams. (Id.-228). In 1666, Capt. Wm. Cockerham
and Mr. Charles Barham were granted 850 acres on the Blackwater for the transportation of
17 persons, among whom were John and Mary Cockerham. (C.P. 562) In 1668, Captain Barham
was appointed a Justice of the County Court and in 1672 he and Robert Caufield presented
the estate of Capt. Cockerham to the Court.

Captain George Watkins in his will made in 1673 refers to "Cousin Charles Barham, son of
my loving Uncle, Capt. Charles Barham"; and makes a bequest of 1000 lbs. of tobacco to
Captain Barham, whom he made co-executor with his wife, Elizabeth Watkins. The exact
relationship between the families has not been definitely determined. (48V. 278-279).
Captain Barham's wife was Elizabeth.........last name unknown. His two daughters, Elizabeth
and Priscilla Barham are given bequests in the will of Wm. Ridley of Isle of Wight, dated
May 1, 1671 and probated Oct. 16, 1671. (W. D. &W. no. 2- pg.98). Capt. Barham was
appointed Sheriff in 1673, and in 1677, after Bacon's Rebellion, was confirmed as a Justice
by Governor Berkeley. He probably served on the County Court until his death.

In 1680 Captain Barham deeded Joseph Rogers, for 8000 lbs. tobacco, 830 acres heretofor
patented by him and Captain Wm. Cockerham in 1666. John Barnes, a prominent Quaker, in his
will dated Mar. 2, 1690, stated: "What is due me from my kinsman, Robert Barham, son of
Capt. Charles Barham, late of Merchant's Hundred, decd., be paid to my wife Jane."
Capt. Barham evidently moved to Merchant's Hundred shortly before his death. His will
probably perished in the destruction of the James City records".

Note: Capt. William Cockerham and Mr. CHARLES (1) BARHAM, patented jointly, 850 acres of land in Surry County, Virginia. This raises the question as to why the land was purchased by the two of them. Capt. William Cockerham married Anne Spencer, the daughter of William Spencer and in 1656 he obtained a grant of 1250 acres in Surry County, 1100 acres of the said tract were due to the said Cockerham as marrying the daughter of Mr. Spencer, to whom it was originally granted.

William Cockerham may have been married prior to his marriage to Anne Spencer, but this has not been proven. He was the father of a daughter, who was married prior to 1669 to Charles Amry.

It seems possible that Anne Spencer Cockerham died at the birth of this younger son.

Charles (1) BARHAM inherited land in England from his elder brother, Edward BARHAM, whose will was dated October 31, 1657 and was proved October 27, 1661. It is also noted that Katherine (Filmer) BARHAM was named as the Executrix of her sons will. It is here noted that just a year after that will was offered for probate, she made her will, dated November 1, 1662 and was proved December 19, 1662. She was living in the Parish of St. Andrew, High Holborn, London. Her younger son, Richard, who lived in London was named the Executor of her estate. The will was proved in the Prerogative Court of Canterbury, London. Though it is known that she died testate, the Will has not been located. The foregoing data on the Barham family has been documented..
Bearing in mind the above notes on Capt. William COCKERHAM and Mr. CHARLES (1) BARHAM, it is here suggested that after the death of Charles (1) Barham's mother, that his sister, SUSAN (named in the Will of her brother, Edward) came to Virginia. She evidently paid her way or her brother, Charles (1) did so, as she was not given as a headright in any land transactions found in Virginia. She, it appears, by May 1666, had become the wife of Capt. Cockerham, whose wife Anne, had died abt. 1665. (No Proof). It has also been observed that the first mention of the wife of Charles (1) BARHAM was made in Surry records on February 2, 1666/67.(old and new calendars)

Note: Knowing that Capt. Cockerham did have two living sons, the question arose as to why Captain CHARLES (1) BARHAM was the sole owner of the land. The logical answer to this question is that the part of the land bought by Capt. Cockerham was in the right of his wife, who was possibly deceased prior to her brother, Captain CHARLES (1) BARHAM. It is well to remember that Capt. Cockerham had much land, which he had as marrying his first wife, and that land would have been heired by the sons.
1666/7, February 2 - This indenture made the 2 day of Feb. 1666. These present witnesseth that I, Dorothy Thorne, is to serve Chas. BARHAM and his wife til next Christmas some six years and the said BARHAM and his wife is to find her sufficient lodging and vittuals and not put her into the ground and the mortar, but to teach her to read and sew and to give her a cotton suite and a preneston (?) NOTE: John Prime made a deposition June 9, 1688 giving his age as 22. (IOW Book 2, p. 280) He apparantly was born in 1665/6 and was 5 or 6 years old when William Ridley's Will was made.
NOTE2: It has been suggested that William RIDLEY was the brother of Elizabeth, the wife of Captain CHARLES (1) BARHAM. So far as is known, his Will is the basis for this assumption, and even though no proof has been found, several genealogists have concluded that Elizabeth was the daughter of PETER RIDLEY and the sister of WILLIAM RIDLEY.
Charles Barham Jr., of Charlottesville, Virginia was searching for his ancestors and in 1958, made an abstract copy of all official records that he had found in his research. He was not completely convinced that Elizabeth's father was a RIDLEY.
Robert Young Barham published a book on his family heritage in 1963. He traces his family back to the youngest son of Captain CHARLES (1) BARHAM. He stated in that publication that Elizabeth was probably the daughter of PETER RIDLEY.
An abstract of the Will of William RIDLEY has been given. It tends to prove that there was a relationship between him and the family of Captain CHARLES (1) BARHAM. Though he names Capt. BARHAM as the Executor of his estate and leaves bequests to the two daughters of Charles (1) BARHAM, he does not denote any relationship.
Though not named in the records along with Captain CHARLES (1) BARHAM, it is more than likely that there was a definite relationship between the TUKE family and the BARHAM family. William TUKE was the son of James TUKE, who came to Virginia in 1621 in the "GEORGE". James TUKE also had a son, Thomas TUKE, who was named as overseer of William RIDLEY'S Will. Charles (1) BARHAM'S great, great grandmother was Mary TUKE, before her marriage to Sir Reginald SCOTT. Mary TUKE was the daughter of Sir Bryan TUKE, secretary to Cardinal Wolsey.

1714, May 11 - Will of John Clarke Probated
Item: I will that my daughter and her husband keep the Plantation they now live on during their naturall life and after their decease I give it to my grandson, John BARHAM and the heirs of his body forever and for want of such heirs I give it to my granddaughter, Elizabeth BARHAM and the heirs of her body.
Item:: I will that my grandson, Robert BARHAM, have my Plantation and all the land belonging to it which I bought of James Briggs for him and the heirs of his body forever and for want of such heirs to my granddaughter Mary and the heirs of her body forever.
Item: I give and bequeath to my grandson Charles BARHAM my gun.
Item: I give to my daughter Elizabeth BARHAM, my gray horse, Turk.
Item: I give to Edward Harris my Simeter and belt.
Item: I give and bequeath all the rest and residue of my personall Estate to Mary, my well beloved wife and do appoint her whole and sole Executor of this, my last Will and Testament and I doe hereby revoak, disanul and make void all form and Wills by me made heretofore. In witness whereof I hereunto sett my hand and seal the 2nd day of October, 1711.

At a Court held at Southwark for the County of Surry, May 15, 1717 the within mentioned Will of John Clark, dec'd, was presented in Court by Mary Clark, Exec. Thereof who made oath thereto and being proved by the oath of Thos. Lane and William Holt, witnesses thereto the same ordered be recorded and is recorded by; Jno. Allen, CL. CT.
Note: John Clarke, whose daughter Elizabeth married Robert BARHAM was born in 1652. He was son of Richard Clarke and wife ............ . On May 6, 1673, John Clarke receipted Wm. Newsum for the estate left him by his father, Richard Clarke. *Surry Book 2, p. 26.
The Tithe lists for 1700/01/02 list him between Robert BARHAM and Wm. Holt. In his excellent article on the "Newsom Family", Va. Magazine of History Vol. XLVII, and succeeding issues, Dr. B.C. Holtzclaw, the author, states that "John Clark's wife, Mary, was probably identical with Mary Flake, etc." This is an error in that Mary Flake married another John Clark. This latter John Clark leased land from Dorothy Meddows, Widow, in 1663.

Mother: The following is taken from the September 9, 1962 edition ofTbe Daily Press under the headline HISTORICAL RARlETIES: .. The song. "A String ofPearls." of this era could have been written for Dame Elizabeth Filmer (Elizabeth Argoll) ofEast Sutton. County Kent. England in 1639. Legacy was Barham Family that eventually came to Virginia... When Dame Elimbeth Filmer, widow or Sir Edward Filmer,. Knight, wrote her will in the above named county of England. she included much jewelry and in particular "four ropes of pearls containing 600 in number." She was a kinswoman of the family of Samuel Argall, who came to Virginia at an early date and was acting Governor for a while.

Since the will contained so much value and of interest to the descendants of the Barham family of Virginia; those in Suny County and James City County, Virginia; the full contents will be given herein:

1638-9, March 16: Will of Dame Elizabeth Filmer. Widow, late the wife of Sir Edward Filmer. knight, of East Sutton. County Kent, England.
Body to Church of East Sutton beside the body of my late husband.
To poor of East Sutton 5 pounds.
To Dame Anne Filmer, wife of my son Sir Robert Filmer. my jewel with diamonds and pearls.
To Elizabeth Filmer their daughter and Sarah Filmer my daughter, my FOUR ROPES OF PEARLS containing 600 IN NUMBER to be equally divided between them.
To Sir Edward Filmer, eldest son of my son Sir Robert, a Portuguese piece of gold and a piece of gold King Henry VII coinage, both of which were his great-grandfather's.
To the two youngest sons ofmy son Sir Robert, viz: Robert and Samuel 40 shillings a piece.
To Anne the youngest daughter of Sir Robert 40 shillings.
To my daughter Mary Knotchbull 40 shillings.
To my daughter Katherine Barham 10 pounds. To her eldest daughter Elizabeth Barham 300 pounds when 21 or married. If she die before, then said 300 pounds to Elizabeth and Ann Filmer, daughters o fmy son Reginold Filmer.

Dame Elizabeth Filmer, willed that her three housed (must mean three apartment or houses (Editor) in Knightrider Street (now that her son Reginold Filmer is deceased) shall be disposed of as follows: 30 pounds of the first year's rent to Jane, late wife of said Reginoid and after the decease of testatrix to the use of her executor the paying yearly to Elizabeth Faulkner, daughter of Dame Elizabeth Filmer and wife of William Faulkner 10 pounds. Whereas Dame Elizabeth Filmer had bequeathed to Elizabeth, daughter of ROBERT BARHAM, gentleman, a competent porcion her will is that 50 pounds of the said legacy in case said Elizabeth depart this before attaining 18 years shall be divided equally between the two daughters of said Reginold and lastly, Dame Elizabeth Filmer willeth 10 Susan Barham 50 pounds apiece (sic) memorandum the legacy 50 pounds apiece to Susan and Anne Barham were entermyned before the signing hereof. HISTORICAL RARIETIES:

Some affluent families came to the Virginia colony and among them was that of the name Barham of Surry County. Since we had the will of Dame Filmer, grandmother of the Captain Charles Barham of Virginia, and she was the lady with the 600 pearls left in her will it was thought that we would include the will of the husband of the Dame Filmer (Elizabeth Argoll). "Dated 5 December 1629 : Will of Sir Edward Filmer of East Sutton, County Kent, England. Sir Edward Filmer, Knight (aged 63 years. January last); To daughter, Elizabeth. wife of Wtlliam Faulkner, citizen and Draper of London 500 pounds. If her husband survives her then to her children 300 pounds equally divided. Ifshe die without issue then to her husband 20 pounds;
To my three sons Edward, John, and Henry Filmer, 10 pounds each. Son Reginold forgiven all debts (500 pounds) and 50 pounds cash. Son Henry, he commences MA in University of Cambridge 40 pounds and further 100 pounds.
Daughters Mary Knathbull and Catherine Barbam, 20 pounds each.
To Edweard Knathbull my Godson 5 pounds. To his sister Mary 20 pounds. To his brother John 2 pounds;
To Edward Barham my Godson 5 pounds; To Elizabeth Barham my wife's Goddaughter 5 pounds.
To other grandchildren, Robert, Thomas, Charles and Richard Barham 40 schillings each;
To Dame Ann wife of my son, Sir Robert Filmer 20 pounds for a ring;
To daughter Sarah 1000 pounds further 500 pounds annuity of 10 pounds to my brother Henry;
To Dorothy, daughter of my brother Anthony Filmer 10 pounds:
To Dame Elizabeth, my wife, 120 pounds. All her chains and jewels and all my household stuff in College house in Maidstone, a third part of linen and silver. My lease of Rectory in East Sutton toward payment of my debts. The other two parts of linen, silver. etc., to my son Sir Robert Filmer. My wife shall have the leases of certain houses in Knightrider Street lately given me by my brother, Robert Filmer, Esq.;

(Reference for the above will of Sir Edward Filmer, Knight, grandfather of Captain Charles Barham of Surry. Virginia: "Virginia Magazine of History and Biography," Vol. 24, pages I58-159. It might be of interest to some of our readers that Henry Filmer of Henrico County, Virginia, an early settler, was son or grandson of the above Sir Edward Filmer. It was through this lineage that many persons have established their lineage back to the Magna Charta and to the Crusaders).
