    Notes:

    In 1661 he is mentioned in the records as a vestryman in Lawnes Creek Church,
    which was the first church built(in 1628)on the south side of the James River.
    In 1681, he moved his family to James City Co.,and at his death in 1683
    owned 463 ac. known as "Martin's Hundred" which he left to his oldest son,
    Charles Jr. who remained in James City Co.

    "Captain Charles Barham of Surry descends from the ancient family of Barham in Kent,
    whose pedigree begins with Warine de Barham, who in1210 held lands in Berham, near
    Canterbury, by Knight service as one of the military tenants of the Archbishop of
    Canterbury. (See article by R. G. Fitzgerald-Uniache, B. A. F. R. S. A. Sussex Arch.
    Soc. LVI (1914) p.110). This family has also resided in Surry County, Virginia
    continuously for more than 300 years. It's present representative is Mr. S. B. Barham,
    now Clerk of the County Court.

    Captain Barham first appears in the Surry records in 1654 as a witness to a bond of
    Andrew Robinson to Dorothy Kew. (D. W. 1645-1715, p.43). He was a vestryman of Lawne's
    Creek Parish first appearing on the list May 24, 1661. On February 2, 1663, Charles
    Barham, gent., of Lawne's Creek Parish bought 300 acres on Hog Island, formerly owned
    by John Medmore, willed to him by heirs in England. Captain Barham paid 63 guineas
    sterling with bills of exchange drawn on his brother RICHARD BARHAM of London. Wits.:
    Wm. Cockerham, Andrew Robinson, David Williams. (Id.-228). In 1666, Capt. Wm. Cockerham
    and Mr. Charles Barham were granted 850 acres on the Blackwater for the transportation of
    17 persons, among whom were John and Mary Cockerham. (C.P. 562) In 1668, Captain Barham
    was appointed a Justice of the County Court and in 1672 he and Robert Caufield presented
    the estate of Capt. Cockerham to the Court.

    Captain George Watkins in his will made in 1673 refers to "Cousin Charles Barham, son of
    my loving Uncle, Capt. Charles Barham"; and makes a bequest of 1000 lbs. of tobacco to
    Captain Barham, whom he made co-executor with his wife, Elizabeth Watkins. The exact
    relationship between the families has not been definitely determined. (48V. 278-279).
    Captain Barham's wife was Elizabeth.........last name unknown. His two daughters, Elizabeth
    and Priscilla Barham are given bequests in the will of Wm. Ridley of Isle of Wight, dated
    May 1, 1671 and probated Oct. 16, 1671. (W. D. &W. no. 2- pg.98). Capt. Barham was
    appointed Sheriff in 1673, and in 1677, after Bacon's Rebellion, was confirmed as a Justice
    by Governor Berkeley. He probably served on the County Court until his death.

    In 1680 Captain Barham deeded Joseph Rogers, for 8000 lbs. tobacco, 830 acres heretofor
    patented by him and Captain Wm. Cockerham in 1666. John Barnes, a prominent Quaker, in his
    will dated Mar. 2, 1690, stated: "What is due me from my kinsman, Robert Barham, son of
    Capt. Charles Barham, late of Merchant's Hundred, decd., be paid to my wife Jane."
    Capt. Barham evidently moved to Merchant's Hundred shortly before his death. His will
    probably perished in the destruction of the James City records".

    Note: Capt. William Cockerham and Mr. CHARLES (1) BARHAM, patented jointly, 850 acres of land in Surry County, Virginia. This raises the question as to why the land was purchased by the two of them. Capt. William Cockerham married Anne Spencer, the daughter of William Spencer and in 1656 he obtained a grant of 1250 acres in Surry County, 1100 acres of the said tract were due to the said Cockerham as marrying the daughter of Mr. Spencer, to whom it was originally granted.

    William Cockerham may have been married prior to his marriage to Anne Spencer, but this has not been proven. He was the father of a daughter, who was married prior to 1669 to Charles Amry.

    It seems possible that Anne Spencer Cockerham died at the birth of this younger son.

    Charles (1) BARHAM inherited land in England from his elder brother, Edward BARHAM, whose will was dated October 31, 1657 and was proved October 27, 1661. It is also noted that Katherine (Filmer) BARHAM was named as the Executrix of her sons will. It is here noted that just a year after that will was offered for probate, she made her will, dated November 1, 1662 and was proved December 19, 1662. She was living in the Parish of St. Andrew, High Holborn, London. Her younger son, Richard, who lived in London was named the Executor of her estate. The will was proved in the Prerogative Court of Canterbury, London. Though it is known that she died testate, the Will has not been located. The foregoing data on the Barham family has been documented..
    Bearing in mind the above notes on Capt. William COCKERHAM and Mr. CHARLES (1) BARHAM, it is here suggested that after the death of Charles (1) Barham's mother, that his sister, SUSAN (named in the Will of her brother, Edward) came to Virginia. She evidently paid her way or her brother, Charles (1) did so, as she was not given as a headright in any land transactions found in Virginia. She, it appears, by May 1666, had become the wife of Capt. Cockerham, whose wife Anne, had died abt. 1665. (No Proof). It has also been observed that the first mention of the wife of Charles (1) BARHAM was made in Surry records on February 2, 1666/67.(old and new calendars)

    On the first of November, 1665, an indenture between John Corker, Gent., and Capt. William Cockerham stated that the latter was living in James City County.

    Note: Knowing that Capt. Cockerham did have two living sons, the question arose as to why Captain CHARLES (1) BARHAM was the sole owner of the land. The logical answer to this question is that the part of the land bought by Capt. Cockerham was in the right of his wife, who was possibly deceased prior to her brother, Captain CHARLES (1) BARHAM. It is well to remember that Capt. Cockerham had much land, which he had as marrying his first wife, and that land would have been heired by the sons.
    1666/7, February 2 - This indenture made the 2 day of Feb. 1666. These present witnesseth that I, Dorothy Thorne, is to serve Chas. BARHAM and his wife til next Christmas some six years and the said BARHAM and his wife is to find her sufficient lodging and vittuals and not put her into the ground and the mortar, but to teach her to read and sew and to give her a cotton suite and a preneston (?) Suite and other things belonging to them and a heifer of two years old att the expiration of her time and ten barrells of Indian Corn as witness our hands this 2 day of Feb. 1666.

    Some affluent families came to the Virginia colony and among them was that of the name Barham of
    Surry County. Since we had the will of Dame Filmer, grandmother of the Captain Charles Barham
    of Virginia, and she was the lady with the 600 pearls left in her will, it was thought that we
    would include the will of the husband of the Dame Filmer (Elizabeth Argoll).
    "Dated 5 December 1629 - Will of Sir Edward Filmer of East Sutton, County Kent, England.
    Sir Edward Filmer, Knight (aged 63 years, January last) ;

    (Reference for the above will of Sir Edward Filmer, Knight, grandfather of Captain
    Charles Barham of Surry, Virginia: "Virginia Magazine of History and Biography," Vol. 24,
    pages 158-159. It might be of interest to some of our readers that Henry Filmer of Henrico
    County, Virginia, an early settler, was son or grandson of the above Sir Edward Filmer. It
    was through this lineage that many persons have established their lineage back to the Magna
    Charta and to the Crusaders).

    Charles Barham, fifth son of Robert Barham and his wife, Elizabeth, daughter of John and
    Mary Clark of Lawnes Creek Parish, Surry Co., Va.. Charles was born in Surry Co. prior to
    1711. He first appears in the Surry records May 19, 1727 (D. & W. 1715-30, p. 750),
    which indicated about 1706 as the probable date of his birth. In 1733 he petitioned
    the House of Burgesses to enable him to sell certain entailed lands and settle others
    more convenient (Journal of the House of Burgesses, 1727-40, pp. 138, 139, etc.)
    In 1738 he was deeded land by Thomas Holt, Jr. in Isle of Wight Co.
    (Isle of Wight D. B. 5, p. 249) and lived in Isle of Wight for a number of years,
    receiving also numerous land-grants in that county, most of which fell into Southampton
    on the organization of that county. He died in Southampton Co. in 1791 at an advanced age.
    His will, dated September 17, 1783 and probated June 9, 1791 (W.B. 4, p.432) leaves his
    property to his son Robert Barham and granddaughter Milly Barham; daughter Lucy Deloach;
    Dewry Parker, husband of his daughter Elizabeth; grandsons Joel and Barham Newsom and
    daughter Mary Harris; son James; and makes his grandson Joel Barham his executor.
    Charles Barham married the first time, probably Sarah Judkins, daughter of John Judkins
    of Surry (Dr. Holtzclaw V.M. 48, p. 359. His second wife was Ann Arrington, widow, of
    Southampton.

    1727/8, February 1 - "At a General Assembly of the House of Burgesses held at the capital in the city of Williamsburg, February 1, 1727 and continued to June 14, 1732, an act to enable Charles (3) BARHAM to sell certain entailed lands and to purchase other lands."
    Whereas Charles (1) BARHAM, late of Martins's Hundred, James City County, Virginia, deceased was in his lifetime seised in fee simple of 463 acres in Martin's Hundred and by his last Will and Testament dated 5 July 1682, devised the same to his son, Charles (2) BARHAM and for want of heirs to his two daughters, ELIZABETH and PRISCILLA and if all of theses should die, to his son, Robert (2) BARHAM. After his death, Charles (2) BARHAM entered and was thereof seised and sold the same and died leaving issue, Charles (3) BARHAM, his eldest son and heir. After his death, Charles (3) BARHAM, the grandson, recovered the said land and is now seised thereof and WHEREAS the said land is all cleared and for want of wood and timber is of little value to the said Charles (3) BARHAM, after the said Charles (3) BARHAM had the opportunity to purchase land in Martin's Hundred containing 250 acres, the greatest part of which is woodland, WHEREAS GRAVES PACKE, Mariner, lately died seised, which he purchased in his lifetime of one John Holden, and to enable him to make purchase hath applied to this General Assembly for an ACT to be pressed to impower him to sell part of the said entailed lands."
