Fox Family
The earliest information on this family is that sometime before the Revolution, Samuel Fox came from England and settled in what is now Nelson county, Virginia, near Avon of that county. This is in the northern part of the county and near the main line of the Chesapeake & Ohio Railroad. Samuel Fox had seven children, namely, Samuel, Richard, Joseph, William, Jackson, Bartlett and Luey.
Of these children, Samuel, Richard and Joseph lived and died in Nelson county, Virginia, and Lucy married a Mr. Quick and moved to some point in what is now West Virginia. William and Jackson Fox moved to what is now Summers county, West Virginia. William Fox had several sons, one of whom was David Fox. David Fox had several sons, two of whom, B. F. Fox and John L Fox, moved to Braxton county. John L. Fox is dead. B. F. Fox lives near Frametown in this county. William Fox had a daughter, Ruth, who married a Lively who was born in Albemarle county, Virginia, about 1780. He married Mary Lively who was born in Albemarle county, Virginia, about the year 1800. Bartlett Fox was born in 1861 and his wife died November 5, 1878.
Bartlett Fox moved to what is known as the Lively place in Nicholas county, about the year 1835; he next moved to what is now the J. B. McLaughlin place near the mouth of the Birch river in 1840; he next moved to what is now the John L. Ballengee farm near the mouth of Strange Creek and next to the farm now owned by Troy Nottingham.
Bartlett Fox had eight children, namely, Samul, M. D., L. F., George W., Tiburtis, Henry, William, Jane and Mary. M. D. L. Fox lived on what is known as the David Evans farm on Leatherwood run; George W. Fox lived the greater portion of his life in the edge of Nicholas county and died on Carpenters Fork of the Little Birch near where John Brown now lives; Tiburtis Fox enlisted in the Confederate army in the begiining of the war between the states and was captured and died in prison in 1861; Henry and William Fox both died prior to the war; Jane Fox married Maxwell H. Frame, and Mary married John S. Nottingham.
Samuel Fox was born on the …. day of ………… 1817, and died the 1st day of October, 1892. He was twice married. His first wife was Susan Boggs, daughter of Benjamin L. Boggs, who died on the 18th of August, 1855, aged 23 years, 4 months and 20 days. There were two children born to this marriage, Camden Fox, on the 14th of December, 1854, and Rebecca Fox, a year or two prior to that date. She married G. R. Mollohan and now lives in California. Samuel Fox's second wife was Mary Dean who is still living. They were marrieda bout 1856.

JAMES MARTIN JR. TO SAMUEL FOX- Dated Dec. 3, 1770 conveys 100 acres more or less on Pounder Branch Amherst County, Virginia-Deed Book "C" p. 398 Consideration: 15 pounds, current money of Virginia. THIS INDENTURE, made this third day of December, in the year of our Lord one thousand seven hundred seventy, between James Martin, Jr., one of the County of Amherst, of the one part, and Samuel Fox, of the said County, of the other part: WITNESSETH: That the said James Martin, Jr., for and in consideration of the sum of Fifteen pounds, current money of Virginia, to him in hand paid by the said Samuel Fox, the receipt whereof he, the said James Martin, Jr., doth hereby acknowledge and of every part and parcel thereof, doth clearly acquit, exonerate and discharge the said Samuel Fox, hath granted, bargained, sold, aliened and confirmed and by these presents doth grant, sell, alien and confirm unto the said Samuel Fox and his heirs, one certain tract or parcel of land containing one hundred acres, more or less, lying and being in the County aforesaid on the Pounder Branch, being part of two hundred acres as per patent to the said Martin, and boundeth as followeth, to-wit: Beginning at a red oak on the Pounder Branch Mountain, running an east course to a red oak; thence to a chesnut oak; thence to a chesnut tree; thence to a chesnut oak; thence to a hiccory, the aforementioned line being made and agreed upon by the said Martin and Fox, to the line to a corner at the red oak on top of the mountain to the first station, now in possesion of said Samuel Fox, with all houses, ways, easements and advantage whatsoever to the said land and premises belonging or appertaining, and also all the estate, right, title, interest, claim and demand whatsoever of him, the said James Martin, Jr., in and to the same to have and to hold the said land with the appurtenances unto the said Samuel fox, his heirs and assigns forever, and the said James Martin, Jr., his heirs and assigns, the said land and premises above mentioned with the appurtenances to the said Samuel Fox, his heirs and assigns against him, the said James Martin, Jr., and his heirs and assigns and all other persons, will warrant and forever defend by these presents. JAMES HULSE TO SAMUEL FOX-Dated September 4,1789 conveys 88 acres on Pounder Branch Anherst County, Virginia- Deed Book "F" p. 398 Consideration: 40 pounds, current money of Virginia. This indenture, made this fourth day of Septemner in the year of our Lord, one thousand seven hundred eighty-nine, between JAMES HULSE of the County of Amherst, planter, And SAMUEL FOX, of the same County, planter, WITNESSETH: That the said James Hulse (or Hulcey), for and in cosideraion of the sum of Forty (40) pounds, current money of Virginia, to him in hand paid before the sealing and delivery of these presents, the receipt whereof he doth hereby acknowledge and therewith to be full satisfaction and paid, hath bargained, sold, aliened, emfeoffed and confirmed, and by these presents doth bargain, sell, a;ien and confirm, unto the said Samuel fox, his heirs and assigns forever: One certain tract or parcel of land containing eight-eight or eighty-nine acres lying as follows, to-wit: and being in the County of Amherst, on both sides of Pounder Branch, beginning at James Martin's corner, running thence with his line N 60 W 70 poles to pointers; thence S 7 W 164 poles to a hiccory; S 74 E 75 poles crossing a branch to a spanish oak; thence S 87 E 40 poles a branch to pointers; thence on Captain James Martin's line due N 142 poles crossing Pounder Branch to the first station, to have and to hold the said tract of land with all houses, buildings, enclosures and emoluments whatsoever of him the said James Hulsey to the said Samuel Fox, his heirs and assigns forever, and the said James Hulcey, his heirs and assigns to the said Samuel Fox, his heirs and assigns, shall and forever will warrant and defend by these presents against any person of persons whatsoever, having or lawfully claiming any estate, right or title in or to the same or any part thereof. Signatures to the deeds were witnessed by Samuel Fox II.DB 2 p.466 Nelson County, VA.
On October 10,1823 Richard W. Fox & Elizabeth Fox gave a deed of trust to secure personal indebtedness. DB 5 p. 15 Nelson CO., VA.

Samuel Fox I, was born in England about the 1730s and came to Virginia while it was still a British colony. The date of his arrival is unknown. It is thought by some Fox researchers that Samuel Fox was sentenced in Middlesex, England in Oct 1758, sentenced to transportation to America in Nov 1758, leaving in early Dec 1758 on the ship "The Brothers" bound for VA, and possibly landing in March or April of 1759. Samuel probably worked as an indentured servant until his first record is found in Dec 1770 in a deed in Amherst Co.,VA.
In a census taken by the Commonwealth of Virginia in 1783, and again in 1785, Samuel Fox was listed as a resident of Amherst County and the head of a family consisting of 11 persons. He was listed as a citizen from Amherst County contributing a blanket for the Continental Army in the Revolutionary War and providing meat. He became one of the early settlers of Western Virginia, when he purchased from James Martin, Jr., a tract of 100 acres "lying and being in Amherst County on PounderBranch" and also a tract or parcel of land containing 88 acres, "lying and being in Amherst County on both sides of Pounder Branch." Pounder Branch is situated near what is now the small town of Afton in what is now Nelson County, VA. Nelson County was formed from Amherst County in 1807. In some deeds of conveyance to Samuel, mention is made of Pounder Branch Mountain, Indian Branch, and "at the foot of the Blue Ridge Mountains on the waters of Rockfish River."
Three sons of Samuel Fox I moved to what is now West Virginia. Bartlett moved to "the Lively Place in Nicholas County" and later moved to the north side of Elk River in the vicinity of what is now Glendon, Braxton County. John moved to Greenbrier County after his brother William and then on to Fayette County. William moved to the vicinity of what is now Brooks P. O. near Hinton, Summers County, WV, what was then Greenbrier County, WV. The other children of Samuel I and Elizabeth lived and died in Nelson County, Virginia.
Samuel's occupation in 1789 was shown as "planter" according to the deed from James Hulse to him. No information is available concerning any other occupations in which he may have been engaged but he is shown as having blacksmith tools in the appraisal of his estate after his decease.. He and his son Bartlett bought a "mill seat" on Meriwether Branch of Rockfish River.. Samuel Fox II and some of the other descendants that stayed in Nelson Co.,VA operated several mills in Nelson and Albemarle Counties, VA.
Samuel made his will on May 18, 1808, at which time he stated "...being of sound mind and memory but in a weak state of health." The will was probated on September 20, 1808, which would indicated that his death probably occurred in or before September 1808.
WILL OF SAMUEL FOX I
IN THE NAME OF GOD, AMEN: I, Samuel Fox of the County of Amhest, being of sound mind amd memory but in a weak state of health, do make and ordain this my LAST WILL AND TESTAMENT in manner and form following, to-wit: I recommend my soul to Almighty god, and my body to the earth to be buried at the discetion of my Executrix and Executors hereinafter mentioned, and after my just debts and financial charges are paid, I give and devise my wordly estate as followeth:
ITEM. I give to my loving wife, ELIZABRTH FOX, (at her request in lieu of dower), fifty acres of that part of my land, taken up by myself whereupon I now live, to include the dwelling house, and to be laid off in such manner as she thinks proper, together with all my stock of every kind, household and kitchen furniture and plantation utensils, (except such as hereafter given in a specific legacy or legacies) during her narural life and at her death to be disposed of in any manner she may think proper.
ITEM. Whereas my son Barttelott (Bartlett) Fox became bound with me in a purchase of a mill seat and some land adjoining of Mr. Charles Bridgewater, it is my will and desire that my said son Barttelott should have the whole benefit arising from the said purchase, seperate and distinct from any part of my other estate, my said son Barttelot paying the balance due of the said purchase and keeping my other estate indemnified therefor and the said Charles Bridewater is hereby requested to convey the title of the same to my said son, Barttelot Fox, fifty acres of that part of my land called Hulcey's tract, adjoining that left to my wife, Elizabeth and Augustine Smith, which I give to him and his heirs forever.
ITEM. I give to my son John Fox forty acres of my said tract of land called Hulcey's tract lying on the Indian Branch from Augustin Smith and extending up the branch of convenient width to form a division, which I give to my said son John and his heirs and assigns forever.
ITEM. I give to my sons William Fox and Joseph Fox the remaining part of my tract of land taken up by myself which is estimated at one hundred acres to be equally divided between them according to quality and quantity, which said land I give to my said two sons and their heirs and assigns forever.
ITEM. I give to my sons Samuel Fox and Richard Fox that part of my land purchased of Captain James Martin, estimated at one hundred acres to be equally divided between my said two sons as to quantity and quality, which said land I giv to my said sons Samuel and Richard and to their heirs and assigns forever.
ITEM. I give to my daughter, Anne Fox, one feather bed, bedstead and furniture, one corner cupboard and one muley cow called Hero, which I give to my said daughter Anne and her heirs and assigns forever.
ITEM. I give to my daughter Susana, wife of David Cary, one shilling.
ITEM. It is my will and desire that George Martin, who intermarried with my daughter Sally (who is since dead) should have no part of my estate but what has already and long since been given her.
ITEM. Lastly, I appoint my loving wife Elizabeth Fox executrix and my three sons, Samuel, Richard and Barttelot, executors of this my last will and testament, hereby-revoking all or any other will or wills heretofor by me made.

At a Court held for Nelson County, this 20th day of September, 1808, this last will and testament of Samuel Fox, deceased, was produced in Court and proven by the oaths of Hudson Martin, Hudson Martin, Jr., and Stephen Martin, subscibing witnesses thereto and ordered to be recorded. And on motion of Bartelott and Samuel Fox, two of the executors in said will named, who made oath according to law and together with Hudson Martin, Jr., their surety, entered into and acknowledged bond in the penalty of One thousand dollars current money conditioned as the law directs, Certificate is granted them for obtaining a probate thereof in due form.

He married Lucinda (Lucy) Mathews in Amherst County, Virginia, February 17, 1800.⁽²⁾ Lucinda was born in VA BET. 1780-1882. Lucinda was the daughter of ? Mathews and ? ?. Lucinda died AFT. SEP 1847 in Fayette Co, (W)VA. Lucinda (Lucy) Mathews was listed as an orphan in Amherst Co,VA. John Fox put up guardianship bond for her and married her the same day. The bond did not list who her parents were. A John Mathews was listed as a son of William Mathews and had a guardianship bond put up for him 2 years before John Fox married Lucinda Mathews. John Fox Sr. was a son of Samuel Fox I. He was born about 1780 in the vicinity of Avon, Virginia. On February 14, 1800, he obtained a license in Amherst County, Virginia, to marry Lucinda (Lucy) Matthews. The ceremony was performed on February 17, 1800.
John and Lucinda migrated to what is now Greenbrier Co.,WV where his brother William had moved to, then to Nicholas Co.,WV, then to Fayette County, West Virginia after his son Harrison Fox migrated there. They bought 108 acres of land in Fayette County on the "Chestnutburg Road".
John and Lucinda were the parents of ten children. John was beneficiary of the will of his father. He and his brother Bartlett, who moved to Braxton County about 1840, inherited nine acres of land which they sold to John Toms on March 12, 1810, for a consideration of 110 Virginia pounds, worth about 3.33 1/3 dollars of current money in the early 1970's. John died in Fayette County between September 1847 and May, 1850. His will, written September 1, 1847, was probated in the countyin May 1850. His wife was alive at the time the will was written.
WILL OF JOHN FOX SENIOR
I John Fox Senior of the County of Fayette State of Virginia a farmer do make and publish this my last will and testament hereby revoking and making void all former wills by me at any time heretofor made; and first I direct that my body be decently intered in the grave yard on the place where I now live and that my funeral be conducted in a manner corresponding with my estate and situation in life, and as to such wordly estate as it hath plesed God to entrust me with I dispose of the same as follows. First I direct that all my debts and funeral expenses be paid as soon after my decease as possibe out of the first moneys that shall come into the hands of my executor from any portion of my estate real or personal. Secondly I hereby will and bequeath to my son William M. Fox all my real estate viz 108 acres being the tract on which I now reside and on which David Martin and Harrison Fox also reside lying and being in the County of Fayette on what is called chesnutburg road also all my personal property except what is hereinafter specially devised to others the said William M Fox to support in a decent manner and take care of my wife Lucinda Fox or cause the same to be done for and during her natural life and the said WM. M. Fox to pay or furnish my three daughters Mahala Cole, Sally Comer, and Elizabeth Skaggs one cow each and to pay to my three Grand children Abigail Shanahun, Mary Shanahun, and Nancy Shanahun or the survivors of them ten dollars to be equally divided among them and paid when they shall respectively become of age also the said William M. Fox is to pay Frances Bowles the sum of six dollars and the sum of one dollar each to my four sons Harrison Fox, John Fox, Gilbert Fox and Madison Fox, as the conditions under which I make the above bequest. I direct and bequeath that my daughter Mary Jane Martin shall have all my household and kitchen furniture and that my grandson Miles Manser Fox Son of Wm. M. Fox shall have my shotgun. The said William M. Fox to keep and maintain wife as aforesaid in lieu of her dower should she so elect otherwise she is to have the remainder of my real and personal estate deducting her dower from his complying with the other conditions of this my will and I do hereby make and ordain my esteemed Son William M. Fox executor of this my last will and testament with full power to carry the same into effect.
