    JOHN POND, the son of JOHN POND and his wife JUDITH, may have
    been older than his brother, THOMAS, and may not have been born in
    Virginia. He was married about 1697 for his first child was born 17 March
    1698. His wife's first name was ELIZABETH and her parents have not been
    identified. The second JOHN POND died in York in York County 10 December
    1718. One ELIZABETH POND, a widow, died 9 April 1748 and she is believed
    to be the widow of JOHN. The children of JOHN POND
    and his wife ELIZABETH were: MARY, born 17 March 1698; JUDITH, born
    27 August 1700; ELIZABETH, born 3 January 1710; JOHN and MARY, twins,
    born 1 November 1706; RICHARD, born 4 January 1710; ESTHER, born
    31 March 1714; and DANIEL, born 15 January 1715. The first MARY died
    9 March 1698/9. It is not unusual in that era to give a child the same name
    as that previously given to a child who was deceased. In 1734 only JUDITH,
    about whom no further record was found, RICHARD and DANIEL were the
    surviving children of JOHN POND and his wife ELIZABETH. JOHN POND
    made a will dated 10 December 1718 and it was proved in York County,
    Virginia Court 19 January 1718/1719. In the will he devised land to sons
    JOHN, who died 2 February 1734, RICHARD and DANIEL. The land devised
    to JOHN and RICHARD was in York County, while the land devised to DANIEL
    was on the Chickahominy River. ELIZABETH, JOHN'S widow, qualified as
    Executrix.
    John Pond was listed on the Quit Rent Roll in 1704 in York County, this
    being the equivalent of a real estate tax list, and he was shown as
    possessing 112 acres of land.

    York County, Court Orders
    Book # 11, Page 2, March 24, 1698
    JOHN POND son of JOHN POND deceased by his petition setting forth to
    this court that whereas since the decease of his father, his mother JUDITH
    POND surviving is administrator of ye said decedent estate. Whereas a part
    belonging to him and another to his brother THOMAS POND, which part or
    share of his said brother is in the hands of said OWEN DAVIS as
    intermarrying with his mother aforesaid, who is since deceased. Now ye
    said petitioners brother being left in New England which if living is aged
    twenty four years, but is now supposed by ye petitioner to be dead.
    Therefore a bond for such part or share of his said brothers estate out of ye
    hands of ye said DAVIS is approved. A deed for record is accordingly granted
    him, he giving bond with security on ye same at ye clerks office sometime
    between this and next court.

    Book # 11, Page 13, April 7, 1698
    Know all men by these presents that we JOHN POND, THOMAS NUTTING
    and FRANCIS CALLOHILL all of ye county of York, Virginia, planters are
    firmly bound unto ye Worshipful his Majesties Justices for ye county
    aforesaid in ye sum of twenty thousand pounds of principal good, sweet
    scented tobacco to be paid to ye said Justices and their Legacies & C. To
    ye which payment will & freely be made, we bind ourselves, our heirs,
    executors and administrators and every of us and them jointly and
    severally firmly by these presents sealed with our seal dated April ye
    7th 1698.
    Whereas JOHN POND son of JOHN POND late of County aforesaid
    deceased, at as court held for ye said County March ye 24th last past by
    this petition, setting forth that his said deceased father left an estate with
    diverse goods and chattels and whereof JUDITH his wife administrator
    being likewise deceased leaving ye above named JOHN POND and
    THOMAS POND the natural sons by ye body of ye said JOHN POND her
    husband begotten. Which said THOMAS POND being absent from this
    country and ye said JOHN his brother moving to be possessed with his
    brothers part of ye estate aforesaid, ye same in behalf of himself and in
    trust for his said brother is accordingly granted. Now ye conditions of this
    obligation is such that if ye above bonded JOHN POND, his heirs,
    executors and administrators of every of them due well and truly save
    harmless and keep in them pacified the said Justices, their heirs and C
    from all damages that shall or may at any time hereafter occur to them
    for granting ye said order. And make payment of all such dues as are or
    may be due to any person from the said estate. This obligation to be paid
    or else remain in full force & C.

    Book 11, Page 25, May the 24th 1698
    JOHN POND son of JOHN POND deceased, making a humble suit to this
    court by his petition sayeth that his said father lying in X estate, the
    administration of his estate was granted to JUDITH his relict, and further yet
    ye said JUDITH being since deceased and ye estate not fully administered
    of as by law and thought and being now in the possession of OWEN DAVIS
    who intermarried with ye said JUDITH. Whereupon the said petitioner
    praying that administration de bonis non administered of ye estate of ye
    said JOHN POND, his deceased father might be to him committed. Ye same
    is accordingly granted he ye said adult, first writing into bond with good
    and sufficient security for (26) his due performance of ye said administration
    according to law at ye clerks office somewhere between this and ye next
    court and that he present an inventory thereto to ye next court on his oath.

    Book 11, Page 548, March, 28th 1702
    #1 The suit depending on this court between JOHN POND plaintiff and
    JOHN CHANLEY defendant in an action of debt for the sum of 500 pounds
    tobacco and caske or two pounds, nine shillings by bill is dismissed.
    The plaintiff not further prosecuting.
    #2 The suit depending on this court between JOHN POND plaintiff and
    JOHN LOOPER defendant in an action of debt for the sum of five pounds
    sterling by bill is dismissed. The plaintiff not further prosecuting.

    Book # 13, Page 40, February 24th 1706
    JOHN POND hath judgment this day granted against JOHN HOUSTON
    ROGERS in a plea of debt for the sum of eight hundred and fifty six pounds
    of tobacco due by bill and is ordered to be paid.

    #1 A Power of Attorney from JOHN ROGERS to JOHN POND was proved
    in court by the oaths of JOHN CLARK, JOHN FRANKLIN and RICHARD
    SLATER witnesses to it and submitted to record.
    #2 JOHN POND by virtue of a Power of Attorney from JOHN ROGERS
    presented and acknowledged the said Rogers his Deed of Gift of land lying
    in this county and Negroes to his son JOHN ADDUSON ROGERS and at his
    motion it is admitted to record.

    Parish in the County of York, being very weak in body and not able to get
    to York Court, do constitute, ordain and appoint my loving friend JOHN

    for me and in my stead and place to acknowledge a certain Deed of Gift
    bearing even date with these presents. And whatsoever my attorney shall
    act or do in the premises, I do hereby ratify, confirm and establish to being
    as full of force and power as if I myself were there in person and accordingly

    Book # 15, Page 13, July 16, 1716
    JOHN POND came into court and made oath that his father JOHN
    POND, his mother JUDITH POND, his brother THOMAS POND and
    himself (the sole survivor) came into this colony to dwell about 28
    years ago and that to the best of his knowledge this is the first time
    of his, their or any of their proving their importation. A certificate is
    accordingly granted him after proving his right to take 200 acres of land.

    Book # 15, Page 378, December 10, 1718
    In the name of God Amen. First I bequeath my soul to God Almighty
    who gave it to me and my body to be decently buried at the direction of
    my executors. And hoping to receive the same again at the general
    resurrection of the dead through the merits of my blessed Lord Savior
    Jesus Christ. For my own good reasons and considerations therefore
    moving, I make this my Last Will and Testament being in perfect sense
    and memory. I do hereby revoke all other Will or Wills whatsoever made
    by me, henceforth I do make this my Last Will and Testament in manner
    and form as followeth. Vir. Imprimis:
    I give and bequeath unto my two son's JOHN POND and RICHARD
    POND my tract of land in the swamp. That is to say the land next to
    ROBERT KERBY'S to my son JOHN to a certain corner Pine in SARAH
    FRANKLIN'S line to across the land as high as JEAN GUESS, South and
    by East to an Ash in Captain NUTTING'S line. The other end unto my son
    RICHARD. The said land I give unto them and their heirs lawfully begotten
    forever, and in case either or both of them should die without heirs then
    unto the next heir as the law should direct.
    I give and bequeath unto my son DANIEL POND a section of land
    containing one hundred acres lying on Chikahmonga River bounded on
    Captain THOMAS MATKINS on a certain run called Ravenous Run. The
    said land I give unto him and his heirs forever.
    The remaining part of my Estate within and without I give unto my
    loving wife for the support of herself and the bringing up of my children.
    To make use of the same as she shall think fit for that purpose and that
    she shall have privilege for any timber upon my land in the swamp for
    her use during her normal life. And she may build or live upon any part
    of it if she thinks it convenient. I do constitute and appoint my loving wife
    to be my sole Executor of this my Last Will and Testament.
    In Witness whereof I have hereunto set my hand and fixed my seal
    this tenth day of December in the year of our Lord One Thousand Seven
    Hundred and Eighteen.

    with their increase to him and his heirs forever. I give and bequeath unto my loving wife
    ELIZABETH WISE during her natural life the use of three Negroes namely Frank, Gofrey
    and Jack to use & employ at her pleasure and at her decease, to be returned unto my son
    CHARLES WISE & be and remain his & his heirs forever. I give and bequeath unto my
    GOD DAUGHTER ELIZABETH POND, two cow calves with their increase to her and
    her heirs &c. I give and bequeath unto Mr. JOHN CHAPMAN twenty shillings current
    money of Virginia to be paid him on demand. I give and bequeath unto my wife
    ELIZABETH WISE & to my sons WILLIAM, ROBERT & CHARLES WISE an equal
    share of all my goods, chattels & moveable estate, to each an equal share and it is my
    desire and will to have all said moveable appraised as by law directed and my debts and all
    charges paid out of the value of the moveable estate and then each to have an exact &
    equal part. And I do make, ordain, constitute and appoint my true & well beloved wife
    ELIZABETH WISE to be whole and sole executrix of this my Last Will and Testament,
    disannulling & making void all other Will or Wills by me made heretofore and I do ordain
    and appoint Mr. JOHN CHAPMAN to oversee that this my Last Will and Testament be
    effectively performed and fulfilled. In Witness whereof I have hereunto set my hand and

    Note: At the time this is the only known Elizabeth Pond residing in the area besides her
    mother Elizabeth Pond. This may indicate that Elizabeth Pond the wife of John Pond was
    a " Wise" before her marriage or that William Wise was just a close family friend.

    In the name of God Amen I Richard Pond of the parish of Nottoway of the county of Southampton being weak now but of perfect and sound mind do make and ordain this as my Last Will and Testament in manner following to wit:
    First. I give and bequeath unto my son Richard one Negro boy called Mun and one sorrel horse called Jock and one feather bed and furniture and after the death of my wife I further give unto my said son Richard the plantation whereon I now live with three hundred and ninety five acres more or less adjoining the same bounded by the huckleberry branch to the head of the said branch and then by a straight line to the line that divides my land from John Vasser to him and his heirs forever.
    Secondly. I give and bequeath unto my son John Hawkins Pond the plantation whereon James Sedget formerly lived with three hundred and ninety fives acres land adjoining more or less bounded by the land given to my son Richard on one side. Also I give my said son John Hawkins two Negro boys James and Isaac and one Bay colt called Blaze and one feather bed and furniture to him and his heirs forever.
    Thirdly. I give and bequeath unto my daughter Elizabeth Moore one Negro woman called Franky also her children Molly, Ben and Caesar and their increase also one feather bed and furniture to her and her heirs forever, all of which she has already in her possession.
    Fourthly. I give and bequeath unto my daughter Mary Pond one Negro woman called Grace and her girl (unreadable) and their increases and also one feather bed and furniture to her and her heirs forever.
    Fifthly. I give and bequeath unto my daughter Martha Pond one Negro girl called Rose and her increase also one feather bed and furniture to her and her heirs forever.
    Sixthly. I give and bequeath unto my daughter Sarah Pond one Negro girl called Morning and her increase also one feather bed and furniture to her and her heirs forever.
    Seventhly. I give and bequeath unto my son Thomas Pond one Negro boy called George also one feather bed and furniture to him and his heirs forever.
    Ninthly. I lend unto my loving wife Martha Pond during her natural life the plantation whereon I now live with three hundred and ninety five acres of land adjoining, bounded as is mentioned as above in the first clause of my Will. Also the use and labor of the following Negroes to wit: Lawrence, Patty, Rachael, Lucy, and Milly. After my just debts and legacies are paid I also lend unto my wife the use of all the residue of my estate of what nature or kind so ever. My will and desire is that after the death of my wife my Negroes Rachael, Lucy and Milly with their increase be equally divided between my son's Thomas and James or the heirs of their body. But if either of my son's Thomas or James should die under age or without issue then my desire is that the survivor of them should have the whole of the legacies herein given the other. And if both of my son's should die under age or without issue then the estate given those to be equally divided amongst my surviving children and their heirs. I further desire after the death of my wife the whole of my estate not herein before given away be equally divided amongst all my children herein named or their heirs.
    And lastly I do hereby Constitute and Appoint my loving wife Executor and my two son's Richard and Hawkins Pond whole and sole executors of this my Last Will and Testament revoking all former Wills by me made. In Witness whereof I have hereunto set my hand and seal this 22 day of September 1777.

    In the name of God Amen I Richard Pond of the parish of Nottoway of the county of Southampton being weak now but of perfect and sound mind do make and ordain this as my Last Will and Testament in manner following to wit:

    DANIEL POND, the son of JOHN POND and his wife ELIZABETH, was
    born in York County, Virginia 15 January 1715. He died in Southampton
    County about January 1786, his will was dated December 1785 and was
    proved in court 9 February 1786. He married about 1740, MARY ________,
    whose parents have not been identified. She may have been a relative of
    WILLIAM TAVENOR whose will was proved in York County 20 May 1751
    in which will she was a legatee, however, no relationship is stated.
    Their first child, JOHN, was born 8 November 1741. Twin sons, DANIEL
    AND SAMUEL, were born of this union 24 December 1742 and were
    baptized 29 January 1743, as shown in the records of Charles Parish.
    The will of DANIEL POND named as legatees his wife MARY; sons
    JOHN, RICHARD, DANIEL and SAMUEL; the last two apparently deceased;
    and daughters ELIZABETH MORRIS and MARY WOOD. His personal
    property, including nine negroes, was appraised at 605 pounds, 14
    shillings, 4 pence. He devised land of 223 acres, on which he lived,
    to his son JOHN POND; however, he previously had deeded 100 acres
    to his son RICHARD POND; and he and JOHN TAYLOR had deeded
    173 acres to his son RICHARD. The land transferred to RICHARD POND
    was located on Brown's Road, which is the highway between the Village
    of Dory and Berlin; the highway is now known as State Route #626.
    DANIEL POND may have moved from York County about 1744, since
    there are no entries in Charles Parish Register concerning him after
    1743. He was in Isle of Wight County before 5 April 1746 for on that date
    THOMAS CLIFTON and BENJAMIN CLIFTON deeded 440 acres of land to
    him. The deed was proved 28 April 1746. This was prior to the
    establishment of Southampton County, which was cut off from Isle of Wight
    1749. In the deed, all the parties are referred to as being of Isle of Wight
    County.
    On 10 August 1749, DANIEL was one of the taxpayers assigned to work
    on the roads under overseer JOSEPH JONES.
    DANIEL POND contributed 290 pounds of beef, to be used by the
    Revolutionary War Forces, on 10 September 1781.
    The 440 acres of land acquired by DANIEL POND from THOMAS and
    BENJAMIN CLIFTON was described as 40 acres on which THOMAS CLIFTON
    lately dwelt and 400 acres adjoining which had been patented by RICHARD

    furniture, likewise two cows and calves at her own disposing. I give the
    use and labor of my Negro ANIKE and my plantation to her during her life.
    I give and bequeath unto my son JOHN POND my lands I now live on
    containing by estimation two hundred and twenty three acres for which he
    will be accountable for at twenty fives pounds per hundred, part of his
    proportion of my estate to him and his heirs forever.
    My will and desire is that the remainder of my estate both real and
    personal be sold and divided into seven equal divisions. One seventh
    part to my son JOHN POND, he giving credit for the sum of value of the
    lands above mentioned to him and his heirs.
    I give and bequeath unto my son RICHARD POND one seventh part
    of my estate value. He giving credit to my estate for two hundred and
    nineteen acres of land at twenty five pounds per hundred as much as
    his seventh part received to him and his heirs forever.

    seventy five pounds, the value of a Negro named DIANAH which she

    and do give and bequeath to my son JOHN POND the goat and chattels
    he made over to me in consequence of my being security for him which
    stands on record in the above county court to him and his heirs forever.
    He having discharged to me by paying the bond and my will and making
    is that this codicil or schedule be esteemed and adjusted to be part of my
    Last Will and Testament. His heirs and assigns may hold the goods and
    chattels as before in reasonable and quick possession. In witness whereof
    the said DANIEL POND has whereunto set my hand this tenth day of
    December 1785. Daniel Pond signed with his mark and it was witnessed

    Daniel Pond's Last Will and Testament plus the Adjustment was
    presented in court on the 9th day of July 1786 and a certificate for probate
    was issued. An Inventory and Account of his estate was made by JOHN
    and RICHARD POND executors on March 5, 1876 and presented in court
    September 14, 1786 with a value of L605.14.04, Will Book # 4, Page 187.
    A final Accounting of the estate in the amount of L 860.16.00, signed by
    JOHN and RICHARD POND was submitted to the court, approved by the

    On this 17th day of September 1832 personally appeared in open court before the justices of the court of Southampton now setting, John Hawkins Pond a resident of the said county and state, aged seventy eight. Who being first Duly sworn according to law doth in his oath make the following declaration in order to obtain the benefit of an Act of Conscript papers June 7th 1832.
    That he entered to service of the State of Virginia at the time Lord Dunmore quitted Williamsburg under the command of Captain Edwin Gray and Lieutenant Benjamin Clements as a volunteer from the County of Southampton. That he served in that tour about 6 weeks. Was called in the service in the Second Division under Captain Elias Herring, marched to Norfolk and remained ten weeks, marched under Captain Samuel Kello to Suffolk, thence to Norfolk and was present when the British were driven from that place to their shipping. He next enlisted in a troop of horse commanded by Captain James Gray and Lieutenant Richard Blow. Joined Colonel Josiah Parker in Isle of Wight county commanding a Troop of Cavalry. Marched next under Captain John Taylor to Petersburg. Was then under the command of General Mulenburg and Major Decloman, commanding the regiment he served in. That he was in that tour of duty about three months, was at the battle of Petersburg, was marched from Petersburg through Richmond to Culpepper county where he was discharged. That he was afterwards ordered to join the Army at York and being on his way when he was ordered to Mc Keys Mills to cut
    and saw timber with the other troops from Southampton for the purpose (as he inserted) to be used in the siege at York. And that while he was in their employment, Cornwallis surrendered. He was discharged and returned home to Southampton. As to the different times when he entered the service, the length of the tour of duty or many of the officers names, from the lapse of time and the effects of
    age tis impossible for him to recollect. That he never had a written discharge as it was not customary for the militia in those days to receive them. That he resided in the county of Southampton, State of Virginia and always entered the service from that county. That he volunteered first under Captain
    James Gray and that in all the other times he was called in the Company or division to which he belonged. That he marched through the counties of Sussex, Prince George, Dinwiddie, Chesterfield, Henrico, and several above Richmond (names not remembered), Charles City, James City, York,
    Surry, Nansemond, Isle of Wight and Norfolk. That he has no documentary evidence but that there are several persons now living who know that the greatest part of the facts as stated in the above declaration are true as will appear by the annexed certificates. That he is well assured that he served nearly 3 years in the different tours of duty during the Revolution. He hereby relinquishes every claim to a pension or annuity except the present and declares that his name is not on the pension roll of the agency of any state or territory.

    The annexed declaration of John H. Pond to this objection by the War Department to his original declaration. The declarant says as to the particular year at which he served under the aforenamed persons, it is impossible, but he can say that he served under Captain Edwin Gray in a town on
    James River to Williamsburg at the time Lord Dunmore ran away, under Captain Herring to Norfolk, under Captain Richard Baily at Suffolk and in the county of Nansemond under Captain Samuel Kello and on Black Water in the Isle of Wight under Captain James gray at Suffolk and Norfolk, under
    Captain Parker (town not recollected), under Captain John Taylor at Petersburg and with the regular officers aforementioned in the original declaration. He always served as a Private in the militia service and is confident he served in different towns during the war nearly or quite three years and the annexed certifications of Elias Levi and William Oney will in part prove the services of the applicant. That he was born in Southampton County, State of Virginia on the 15th of July 1755 and has a record of his age now in his possession and has always resided on the place he was born in the County of Southampton and where he expects to be buried. Pond. Elias Levi with him at Petersburg at Mc Keys Mills, at Norfolk, at Girceffo near Suffolk. William Oney served William at Williamsburg, at Petersburg, Richmond and Elias Levi with him at Bable old field in Nansemond County but under what particular officers at the above stated places from time and loss of memory tis impossible for them to State.     1st. I give my son Hawkins Pond all my lands I possess and one Negro woman by the name of old Ester and another woman by the name of Martha. Lands and Negroes to him and his heirs forever.

    2nd. I give to my daughter Helena Axum the following Negro slaves to Wit: A Negro man by the name of Daniel and another one by the name of Sam, another one by the name of Bob, a young Negro girl by the name of young Ester, one other Negro woman by the name of Betty and her three children by the name of Miles, Ben and Becky to her and her heirs forever.

    3rd. I give to my grandson William C. Pond my sorrell horse, saddle and bridle to him and his heirs forever.

    4th. I give to my granddaughter Rhoda Ann Vick one feather bed and furniture to her and her heirs forever.

    5th. My will and desire is that all my just debts bge paid and the residue of all my property be sold and the money araising from said sales be equally divided between my son Hawkins Pond and my daughter Helena Axum to them and their heirs forever. 6th. And lastly I do hereby appoint my son Hawkins Pond and John Axum executors of my said Will and Testament.

As to the different times when he entered the service, the length of the tour of duty or many of the officers names, from the lapse of time and the effects of
    age tis impossible for him to recollect. That he never had a written discharge as it was not customary for the militia in those days to receive them. That he resided in the county of Southampton, State of Virginia and always entered the service from that county. That he volunteered first under Captain
    James Gray and that in all the other times he was called in the Company or division to which he belonged. That he marched through the counties of Sussex, Prince George, Dinwiddie, Chesterfield, Henrico, and several above Richmond (names not remembered), Charles City, James City, York,
    Surry, Nansemond, Isle of Wight and Norfolk. That he has no documentary evidence but that there are several persons now living who know that the greatest part of the facts as stated in the above declaration are true as will appear by the annexed certificates. That he is well assured that he
    served nearly 3 years in the different tours of duty during the Revolution. He hereby relinquishes every claim to a pension or annuity except the present and declares that his name is not on the pension roll of the agency of any state or territory.

    The annexed declaration of John H. Pond to this objection by the War Department to his original declaration. The declarant says as to the particular year at which he served under the aforenamed persons, it is impossible, but he can say that he served under Captain Edwin Gray in a town on James River to Williamsburg at the time Lord Dunmore ran away, under Captain Herring to Norfolk, under Captain Richard Baily at Suffolk and in the county of Nansemond under Captain Samuel Kello and on Black Water in the Isle of Wight under Captain James gray at Suffolk and Norfolk, under Captain Parker (town not recollected), under Captain John Taylor at Petersburg and with the regular officers aforementioned in the original declaration. He always served as a Private in the militia service and is confident he served in different towns during the war nearly or quite three years and the annexed certifications of Elias Levi and William Oney will in part prove the services of the applicant. That he was born in Southampton County, State of Virginia on the 15th of July 1755 and has a record of his age now in his possession and has always resided on the place he was born in the County of Southampton and where he expects to be buried.     This 12th of June 1833 personally appeared before me at Jerusalem William Oney aged 71 years and Elias Levi aged 81 years and made oath before me according to law that they were in the service in the Revolutionary War with John H. Pond. Elias Levi with him at Petersburg at Mc Keys Mills, at Norfolk, at Girceffo near Suffolk. William Oney served William at Williamsburg, at Petersburg, Richmond and Elias Levi with him at Bable old field in Nansemond County but under what particular officers at the above stated places from time and loss of memory tis impossible for them to State.     I John H. Pond of the County of Southampton freely make my last Will and Testament in manner and form following.
    1st. I give my son Hawkins Pond all my lands I possess and one Negro woman by the name of old Ester and another woman by the name of Martha. Lands and Negroes to him and his heirs forever.
    2nd. I give to my daughter Helena Axum the following Negro slaves to Wit: A Negro man by the name of Daniel and another one by the name of Sam, another one by the name of Bob, a young Negro girl by the name of young Ester, one other Negro woman by the name of Betty and her three children by the name of Miles, Ben and Becky to her and her heirs forever.
    3rd. I give to my grandson William C. Pond my sorrell horse, saddle and bridle to him and his heirs forever.
    4th. I give to my granddaughter Rhoda Ann Vick one feather bed and furniture to her and her heirs forever.
    5th. My will and desire is that all my just debts bge paid and the residue of all my property be sold and the money araising from said sales be equally divided between my son Hawkins Pond and my daughter Helena Axum to them and their heirs forever.
    6th. And lastly I do hereby appoint my son Hawkins Pond and John Axum executors of my said Will and Testament. In witness whereof I have been assisted to set my hand and affix my seal this 23rd day of July 1832.

    In the name of God amen, I HAWKINS POND of the county of Surry in the sate of Virginia, do make and ordain this to be my Last Will and Testament.

    First. I desire and direct that all my just debts be paid immediately after my death.

    Second. I give my daughter ANN HOLT, wife of ROBERTSON HOLT five dollars and no more of my estate, to her and her heirs forever.

    Third. I give to my son THOMAS C. POND five dollars to him and his heirs forever.

    Fourth. I loan to my son JAMES POND for and during his life my slaves Henry (Carr), Merit, Randell, little Lewis, and John. And at his death, I give said slaves to any child or children he may have, at his death. But should he have no children, then I give the said negro slaves above named to the children of my son JOHN H. POND, and my daughter MARY GOODRICH in equal proportions to wit: one half to JOHN H. POND'S children and the other half to MARY GOODRICH'S children.

    Fifth. I loan to my son JOHN H. POND for and during his life my slaves Siman, Jack, Norflet, Ben, Jim, Eliza and her children (Junius & Imogan) and her future increase and their increase in this fifth clause named to the children of my said son JOHN H. POND should he leave any. And in case he leave none, I give the same to the children of my son JAMES POND and of my daughter MARY GOODRICH, to them and their heirs forever. And I also loan to my said son JOHN H. POND, what I consider to be about twelve hundred acres of land commencing at SPRATLEY'S line, going up the mill race, taking the east stream to JOHN HARRIS'S line and all the land known as Birch Island on the North side of Black Water being all the land I own on that side of Birch Island, and also my mill seal with all things appurtenant and belonging to it as it now stands, to him and his heirs forever. And at his death, I give said land to such one of his children as he may name after me or with my name, and should he have none to bear my name, then I give all said land, mill seal , to such other child or children as he may leave at his death. But should leave no child surviving him, then said land is to go to the children of my son JAMES POND and my daughter MARY GOODRICH, to them and their heirs forever.

    Sixth. I loan to my daughter MARY GOODRICH wife of ALBERT D. GOODRICH my slaves Willis (Pond), Henry (Pretlow), Sam Henry (Holliman), Willis (Cokes), Margaret and her increase Wesly and Big Lewis, and at her death I give the said slaves in this sixth clause named to the children of my said daughter MARY GOODRICH or should she die leaving no child surviving her, I give said slaves and the increase of the female thereof to the children of my sons JAMES POND and JOHN H. POND, to them and their heirs forever. I also loan my said daughter MARY GOODRICH the remainder of my land supposed to be about 8 hundred acres, adjoining the tract herein loaned my son JOHN H. POND. And at her death, I give said land in this clause named, and hereby loaned her, to her children should she leave any. And should she leave none surviving her, I give the same to the children of my sons JAMES POND and JOHN H. POND, to them and their heirs forever.

    Seventh. It is my will and desire and I do especially desire that the slaves hereby loaned to my sons JAMES and JOHN H. POND, and to my daughter MARY GOODRICH be kept, held, and used exclusively by them for their own purposes, during their respective lives and never be loaned or hired by either of my said children to ROBERTSON HOLT or his said wife ANN, upon pain of the one so hiring or loaning to said HOLT and wife, or either of them either of said slaves, that he or she is to be deprived of all further use of the salves so loaned him or her. And in that event, the slaves hereby loaned him, or her, is to go and pass as if he or she were dead.

    Eighth. I desire that my slaves Iris, Milton, Fanny, Claiborne and Antinette be hired out to such person or persons as they the said slaves may select by my executors for the space of fifteen years from and after my death. After the expiration of which time, I direct that said slaves as such of them as may be then alive be sent by my executors to some one of the free states. The hires arising from said slaves to be collected and deposited in some savings bank in Virginia.

    Ninth. Should Imos sell my slaves Britten and Daniel during my life, I desire my executors to do so in the city of Richmond as soon as convenient after my death. And after paying my just debts out of the sales of my property, not herein before given away or loaned or otherwise disposed of (which my executors are hereby directed to sell) and from the sales of said Britton and Daniel, I direct my executors to deposit in a savings bank as aforesaid the whole net proceeds of sales of said Britten and Daniel and of my estate not previously by this Will disposed of, from which amount so reported in bank I appropriate one thousand dollars to be used in carrying Iris and her children Vizt: Milta, Fanny, Claiborne and Antinette and such further or other increase of said Iris as may be borne of her to some free state, and the balance of the money, upon a fair settlement of my estate remaining, I wish and direct to be kept as a fund to be used in the education of my grand children (the children of my sons JAMES and JOHN H. POND and my daughter MARY GOODRICH. And should there remain more than enough to educate my said grand children, then the remainder is to be divided into three equal shares, one of which shares is to go to JAMES POND'S children, one share to go to JOHN H. POND'S children and the other share to go to MARY GOODRICH'S children. And in any and all events, my negroes Iris and her children aforesaid are to be comfortably supported and should their hires be unsufficient for that purpose, then my estate is to furnish the means for the purpose. And I direct that said last aforesaid negroes be taken from my present residence immediately after my death and provided with good comfortable houses by my executors.

    Tenth. I hereby reserve for the use of my family for all time to come, one acre of land I have before loaned my son JOHN H. POND (a part of which is now enclosed) as a grave yard or family burial ground. I give my slave Harry to FRANK BAIN of Sussex County.

    Lastly. I nominate and appoint my friends THOMAS J. DRUMWRIGHT and WILLIAM P. UNDERWOOD executors of this my Last Will and Testament, hereby revoking and making null and void all Wills by me heretofore made.     This Last Will and Testament of HAWKINS POND deceased was this day presented in Court and proved according to law by the oaths of JAMES M. HARVELL, JOHN P. PLEASANT and WILLIAM P. UNDERWOOD the subscribers witnesses thereto, and thereupon was admitted to record. And on motion of THOMAS J. DRUMWRIGHT and WILLIAM P. UNDERWOOD the executors in said Will named, who made oath thereto. And the said THOMAS J. DRUMWRIGHT with TIMOTHY E. ATKINSON, BENJAMIN C. DREW and JOHN C. BAUGH his securities and the said WILLIAM P. UNDERWOOD with EDWIN WHITE and WILLIAM DILLARD as his securities (all of said securities justifying on oath as to their sufficiency, entered severally into a bond in the penal sum of forty thousand dollars conditioned as the law directs. GOODRICH my slaves Willis (Pond), Henry (Pretlow), Sam Henry (Holliman), Willis (Cokes), Margaret and her increase Wesly and Big Lewis, and at her death I give the said slaves in this sixth clause named to the children of my said daughter MARY GOODRICH or should she die leaving no child surviving her, I give said slaves and the increase of the female thereof to the children of my sons JAMES POND and JOHN H. POND, to them and their heirs forever. I also loan my said daughter MARY GOODRICH the remainder of my land supposed to be about 8 hundred acres, adjoining the tract herein loaned my son JOHN H. POND. And at her death, I give said land in this clause named, and hereby loaned her, to her children should she leave any. And should she leave none surviving her, I give the same to the children of my sons JAMES POND and JOHN H. POND, to them and their heirs forever.
    Seventh. It is my will and desire and I do especially desire that the slaves hereby loaned to my sons JAMES and JOHN H. POND, and to my daughter MARY GOODRICH be kept, held, and used exclusively by them for their own purposes, during their respective lives and never be loaned or hired by either of my said children to ROBERTSON HOLT or his said wife ANN, upon pain of the one so hiring or loaning to said HOLT and wife, or either of them either of said slaves, that he or she is to be deprived of all further use of the salves so loaned him or her. And in that event, the slaves hereby loaned him, or her, is to go and pass as if he or she were dead.
    Eighth. I desire that my slaves Iris, Milton, Fanny, Claiborne and Antinette be hired out to such person or persons as they the said slaves may select by my executors for the space of fifteen years from and after my death. After the expiration of which time, I direct that said slaves as such of them as may be then alive be sent by my executors to some one of the free states. The hires arising from said slaves to be collected and deposited in some savings bank in Virginia.
    Ninth. Should Imos sell my slaves Britten and Daniel during my life, I desire my executors to do so in the city of Richmond as soon as convenient after my death. And after paying my just debts out of the sales of my property, not herein before given away or loaned or otherwise disposed of (which my executors are hereby directed to sell) and from the sales of said Britton and Daniel, I direct my executors to deposit in a savings bank as aforesaid the whole net proceeds of sales of said Britten and Daniel and of my estate not previously by this Will disposed of, from which amount so reported in bank I appropriate one thousand dollars to be used in carrying Iris and her children Vizt: Milta, Fanny,
    Claiborne and Antinette and such further or other increase of said Iris as may be borne of her to some free state, and the balance of the money, upon a fair settlement of my estate remaining, I wish and direct to be kept as a fund to be used in the education of my grand children (the children of my sons JAMES and JOHN H. POND and my daughter MARY GOODRICH. And should there remain more than enough to educate my said grand children, then the remainder is to be divided into three equal shares, one of which shares is to go to JAMES POND'S children, one share to go to JOHN H. POND'S children and the other share to go to MARY GOODRICH'S children. And in any and all events, my negroes Iris and her children aforesaid are to be comfortably supported and should their hires be unsufficient for that purpose, then my estate is to furnish the means for the purpose. And I direct that said last aforesaid negroes be taken from my present
    residence immediately after my death and provided with good comfortable houses by my executors.
    Tenth. I hereby reserve for the use of my family for all time to come, one acre of land I have before loaned my son JOHN H. POND (a part of which is now enclosed) as a grave yard or family burial ground. I give my slave Harry to FRANK BAIN of Sussex County.
    Lastly. I nominate and appoint my friends THOMAS J. DRUMWRIGHT and WILLIAM P. UNDERWOOD executors of this my Last Will and Testament, hereby revoking and making null and void all Wills by me heretofore made. Witness my hand and seal this sixth day of March, one thousand eight hundred and sixty one.

    In Surry County Court 22nd April 1861.
    This Last Will and Testament of HAWKINS POND deceased was this day presented in Court and proved according to law by the oaths of JAMES M. HARVELL, JOHN P. PLEASANT and WILLIAM P. UNDERWOOD the subscribers witnesses thereto, and thereupon was admitted to record. And on motion of THOMAS J. DRUMWRIGHT and WILLIAM P. UNDERWOOD the executors in said Will named, who made oath thereto.
    And the said THOMAS J. DRUMWRIGHT with TIMOTHY E. ATKINSON, BENJAMIN C. DREW and JOHN C. BAUGH his securities and the said WILLIAM P. UNDERWOOD with EDWIN WHITE and WILLIAM DILLARD as his securities (all of said securities justifying on oath as to their sufficiency, entered severally into a bond in the penal sum of forty thousand dollars conditioned as the law directs. A Certificate is granted them for obtaining a probate of said Will in due form.
